TERMS AND CONDITIONS OF SALE

It is hereby specified that the present conditions govern the sales, by SPL Agate - Office de Tourisme, of all the products in the online store.

1 - THE PRICE

The prices of our products are indicated in Euros, all taxes included, excluding shipping and packaging costs. This amount is specified during the order validation phase. For orders to countries other than metropolitan France, you are the importer of the products concerned. For all products shipped outside the European Union and French overseas departments and territories, the price will be automatically calculated inclusive of all taxes on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. SPL Agate - Office de Tourisme is not responsible for these charges. You are entirely responsible for their payment and declaration to the appropriate authorities in your country. We advise you to check with your local authorities. All orders, whatever their origin, are payable in Euros. SPL Agate - Office de Tourisme reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in force at the time orders are registered, subject to availability. Products remain the property of SPL Agate - Office de Tourisme until full payment has been received.

2 - ORDERING

All orders to the SPL Agate - Office de Tourisme online store imply unreserved acceptance of the present Terms and Conditions, which are visible at the time of ordering and must be ticked.

SPL Agate - Office de Tourisme reserves the right not to register a payment, and therefore not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of any difficulty concerning the order received.

The customer has a cooling-off period of 14 working days to return the order in its original packaging for exchange or reimbursement, the cost of return being borne by the customer.

3 - AVAILABILITY

Our products are offered while stocks last. For products not in stock, our offers are subject to availability from our suppliers.

If a product is unavailable after you have placed your order, we will inform you by e-mail. You can then request cancellation of your order by writing to the following e-mail address: boutique@ot-nimes.fr

4 - DELIVERY

Deliveries to the SPL Agate - Office de Tourisme online store are handled by La Poste.

Products are delivered to the delivery address you have indicated during the order process.
All orders placed after 12 noon on Fridays will be dispatched the following Monday.

5 - PAYMENT

Payment can be made by credit card: Visa, MasterCard, American Express and JCB.

6 - SAFETY

Our site's security system is partnered with Crédit Mutuel's Monetico paiement secure payment service.

No confidential personal data can be entered on the www.nimes-tourisme.com website. Confidential information is only entered at the time of payment via the secure Crédit Mutuel Monetico payment site, and is under no circumstances transmitted to or stored on the SPL Agate - Office de Tourisme website.

7 - LIABILITY

The products offered comply with current French legislation. SPL Agate - Office de Tourisme cannot be held responsible for any failure to comply with the legislation of the country where the products are delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.

SPL Agate - Office de Tourisme cannot be held responsible for the photographs used to describe the products.

SPL Agate - Office de Tourisme cannot be held responsible for the non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications, flooding, fire or other natural disasters.

SPL Agate - Office de Tourisme shall not be held liable for any indirect damage, operating loss, loss of profit, loss of luck, damages or expenses.

8 - PERSONAL INFORMATION

SPL Agate - Office de Tourisme undertakes not to divulge to third parties any information communicated to it. This information is confidential. It will only be used by its internal departments to process the order, and in particular for newsletters to which the customer has subscribed.

The data collected by SPL Agate - Office de Tourisme in its capacity as data controller is processed for the purpose of selling and delivering products.

9 - APPLICABLE LAW

Disputes arising from the application of these general terms and conditions of sale are subject to French law and fall within the jurisdiction of the Tribunal de Commerce de Nîmes. Only the French version of these terms and conditions shall be deemed authentic for the purposes of their interpretation.
